Contaminated Sites
In Western Australia, land that is known or suspected to be contaminated falls under the Contaminated Sites Act 2003 and is regulated by the Department of Water and Environmental Regulation (DWER).
What is Contamination?
The Act defines a Contaminated Site as having a substance present in or on that site of above background concentrations that presents, or has the potential to present, a risk of harm to human health, the environment or any environmental value.
When Do I Need an Environmental Professional?
An investigation into site contamination is most commonly initiated in the following situations:
- Buying/Selling Property - as part of your due diligence checks.
- Land Devlopment - to fulfill a planning condition such as for subdivision or development approval.
- Required under the Act - when a site has been classified as "possibly contaminated - investigation required" by DWER under the Act.
